Please read these Terms carefully before placing an order. By placing an order with us, you confirm that you have read, understood, and agree to be bound by these Terms.

1. About Us

References to "we," "us," and "our" throughout these Terms refer to BioFusion Peptides. We provide research-grade products intended strictly for qualified laboratory and scientific research purposes. You can contact us at support@biofusionpeptides.ca .

2. Definitions

• "Products" means the research peptides and related materials listed for sale on our site.
• "Customer" means any individual or entity purchasing Products from us.
• "Order" means a request by a Customer to purchase one or more Products.
• "Site" means the BioFusion Peptides website and associated online services.

3. Acceptance of Terms

By accessing our site or placing an Order, you confirm that you:

• Are of legal purchasing age in your jurisdiction
• Are acting in a professional or academic research capacity
• Have read and agree to these Terms in full
• Understand that our Products are sold strictly for in vitro laboratory and research use only

If you do not agree to these Terms, you must not use our site or purchase our Products.

4. Eligibility and Buyer Warranty

Our Products are sold exclusively for legitimate scientific research, in vitro laboratory studies, and related academic or commercial research activities. They are not intended for, and must not be used for, human or animal administration, therapeutic purposes, dietary supplementation, or any application outside a controlled research environment.

By placing an Order, you warrant and represent to us that:

• You are purchasing our Products solely for lawful research or laboratory purposes
• You have the appropriate qualifications, training, and institutional authorisation to handle research-grade chemical compounds
• You will not resell, redistribute, or supply our Products to any third party for purposes other than legitimate research
• You will store and handle our Products in accordance with applicable health and safety requirements and product documentation
• Your purchase and use of our Products is lawful in the jurisdiction(s) in which you operate

We reserve the right to refuse any Order at our sole discretion, including where we have reason to believe that the Products may be misused.

5. Products and Availability

All Products are subject to availability. We reserve the right to withdraw any Product from sale at any time without notice.

Product descriptions, images, and specifications are provided for information purposes only. Whilst we take care to ensure accuracy, minor variations may occur between batches. The Certificate of Analysis for each batch is the definitive reference for product specification.

We do not make any representations, warranties, or guarantees regarding the suitability of our Products for any specific research application. It is the Customer's responsibility to determine the suitability of any Product for their intended research purposes.

6. Pricing and Payment

All prices are displayed in the applicable currency shown on the Site or at checkout. Prices, taxes, duties, fees, and other applicable charges may vary depending on your location, including Canada, the United States, and other regions where our services are available.

We reserve the right to amend prices at any time. The price applicable to your Order will be the price displayed at the time of checkout.

Payment is required in full at the time of ordering. We accept payment via the methods displayed at checkout. Orders will not be processed until payment has been successfully verified.

We are not responsible for any charges applied by your bank, card issuer, payment provider, customs authority, or other third party in connection with your purchase.

7. Orders and Contract Formation

An Order constitutes an offer by you to purchase Products in accordance with these Terms. Our acceptance of your Order is confirmed by our dispatch confirmation email, at which point a binding contract is formed.

We reserve the right to decline or cancel any Order, including after a confirmation email has been sent, where:

• A Product becomes unavailable
• A pricing or listing error has occurred
• Payment cannot be verified or authorised
• We have reason to believe the Order may involve misuse of our Products
• Fulfilling the Order may conflict with applicable legal, regulatory, shipping, or import requirements

Where payment has already been collected for an Order that we cancel, we will issue the appropriate refund to the original payment method.

8. Shipping and Delivery

Orders are processed on business days, Monday to Friday, excluding applicable public holidays. Orders placed before the applicable cut-off time on a business day will typically be dispatched the same day, subject to stock availability and payment verification. Orders placed after the cut-off, or on a non-business day, will be processed on the next available business day. You will receive an email confirmation upon dispatch, including tracking information where applicable.

Delivery options and rates are displayed at checkout based on your delivery location. Shipping availability, estimated delivery times, customs requirements, duties, taxes, and import restrictions may vary depending on the destination, including Canada and the United States.

Customers are responsible for ensuring that the Products they order may lawfully be purchased, imported, received, possessed, and used in their jurisdiction. We reserve the right to restrict or cancel shipment to destinations where legal, regulatory, carrier, or customs requirements prevent fulfilment.

Delivery to remote or extended regional areas may require additional transit time.

All orders are dispatched securely in protective packaging to help protect Products during transit. Products are sealed and labelled in accordance with our quality assurance standards.

Research peptides can be sensitive to temperature, light, and humidity. Each product page may include a Storage and Stability section outlining recommended conditions for that compound. Upon receipt, it is the Customer's responsibility to store Products in accordance with the applicable product information. We accept no liability for product degradation arising from improper storage by the recipient following delivery, except where liability cannot lawfully be excluded.

If your order arrives damaged, incomplete, or significantly delayed beyond the estimated delivery window, please contact us at support@biofusionpeptides.ca within 7 days of delivery or, for a potentially lost shipment, within 7 days of the expected delivery date. Please retain all original packaging, as this may be required to resolve the matter. We will investigate such reports and address eligible claims in accordance with Section 9 below.

9. Returns and Refunds

Your rights regarding faulty, damaged, incorrect, or otherwise non-conforming Products may vary depending on the laws applicable to your location. Nothing in these Terms is intended to exclude or restrict any rights or remedies that cannot lawfully be excluded.

Due to the sealed, sensitive, and research-specific nature of our Products, change-of-mind returns may be restricted once a Product has been opened, used, or its safety seal has been broken, subject to applicable law.

If something goes wrong with your Order, please contact us in the first instance at support@biofusionpeptides.ca.

Subject to applicable law and our assessment of the claim, we may offer a refund, replacement, or other appropriate remedy where:

• The Product received differs materially from what was ordered
• The Product arrived visibly damaged or compromised in transit
• The Product is materially outside the specification stated on the applicable Certificate of Analysis
• The shipment has been confirmed lost by the carrier or otherwise qualifies for a remedy under applicable law

To help us assess a return or refund request:

• Notify us as soon as reasonably possible and, where practicable, within 7 days of receiving the Order
• Retain Products in their original, unopened, and undamaged condition where possible
• Provide your Order reference number and a description of the issue
• Provide photographs or other supporting evidence where relevant

Except where applicable law provides otherwise, we may be unable to accept a return where:

• The Product has been opened, used, altered, or is no longer in its original sealed condition
• The Product has been stored or handled outside the recommended conditions
• The return request is based solely on a change of mind after the Product has been opened
• The issue arose from misuse, improper handling, or use outside the Product's stated research purpose

We assess each case individually. Where a return is authorised, return instructions will be provided by our support team. We recommend using a tracked shipping service for returned Products. Approved refunds will be issued to the original payment method within a reasonable processing period and subject to applicable payment-provider timelines.

Orders may generally be cancelled before dispatch. Once an Order has been dispatched, cancellation may no longer be possible and the applicable returns process will apply. To request a cancellation, email support@biofusionpeptides.ca as soon as possible with your Order reference.

10. Prohibited Uses

You must not use our Products for any of the following purposes:

• Human or animal administration of any kind
• The manufacture, compounding, or preparation of any medicinal, therapeutic, dietary, or veterinary product
• Any purpose that is unlawful in your jurisdiction
• Resale or redistribution for non-research purposes
• Any application requiring institutional, regulatory, ethical, or safety approval where such approval has not been obtained

Breach of this clause may result in suspension of your account, cancellation of outstanding Orders, refusal of future Orders, and reporting to relevant authorities where required by applicable law.

11. Limitation of Liability

To the fullest extent permitted by applicable law, we shall not be liable for loss, damage, injury, or harm arising from:

• Misuse of our Products outside their stated research purpose
• Failure by the Customer to comply with applicable storage, handling, safety, legal, or regulatory requirements
• Use of Product descriptions or third-party information as a substitute for appropriate professional or scientific judgment
• Indirect, incidental, consequential, special, or similar losses to the extent such losses may lawfully be excluded

Nothing in these Terms excludes or limits any liability or legal right that cannot lawfully be excluded or limited under applicable law.

To the extent permitted by applicable law, our aggregate liability in connection with an individual Order shall not exceed the amount paid by you for that Order.

12. Intellectual Property

All content on the Site, including text, images, logos, graphics, product information, and documentation, is owned by BioFusion Peptides or used under applicable licence and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, republish, or commercially use Site content without our prior written consent, except where permitted by law.

13. Privacy

Your use of our Site and our handling of personal information are subject to our Privacy Policy. Privacy rights and requirements may vary depending on your location, including Canada, the United States, and other applicable jurisdictions.

14. Amendments

We reserve the right to amend these Terms from time to time. The version published on the Site at the time of your Order will generally apply to that transaction, subject to any mandatory legal requirements. We recommend reviewing these Terms periodically.

15. Governing Law and Jurisdiction

These Terms are subject to the laws applicable to BioFusion Peptides' operations and to the particular transaction. Depending on the Customer's location, additional mandatory rights, protections, or legal requirements may apply, including under applicable Canadian federal and provincial laws and applicable United States federal and state laws.

Any dispute arising from or relating to these Terms shall be addressed through the courts, tribunals, dispute-resolution procedures, or other legal channels having proper jurisdiction under applicable law. Nothing in this section is intended to deprive a Customer of any mandatory rights or protections available in their jurisdiction.
